Conditions of Hire
- Minimum Charge one day.
- Weekend charged at normal daily rates for days involved.
- We charge TIMEOUT - NOT TIME USED.
- ALL hire is payable in advance - no deposit necessary.
- Identification required - 2 forms of documentation necessary.
- All equipment fully serviced prior to hiring.
- Long term rates on application.
- Hire rates do not include consumables - Abrasives, Cutting Wheels, Detergents, Nails, Wheels, Drills
Gas, Fuel, Stamp Duty, Damage Waiver etc. - Damage Waiver available for your protection.
- We reserve the right to change rates without notice.
- If the equipment you require is not listed, please enquire as
we are constantly adding to our range. - GST charged at current Government rate.
Payment Methods
We accept cash, cheque, EFTPOS and major credit cards (Visa and Mastercard). Payment is required at the start of the hire or prior to delivery.
Pricing
Citiwest Rentals works to maintain prices at the lowest level. Occasionally, prices change without notice due to circumstances beyond our control and you will be notified before delivery of goods.
The Hirer Agrees
To pay hire charges invoiced by the owner until goods are returned to owners premises.
To pay owner for any equipment lost or stolen while on hire at rates as invoiced by the owner.
To pay for repairs to any equipment damaged while on hire as invoiced by the owner.
That the owner has the right to terminate the hire and recover the hired equipment at any time.
That no warranty or condition express or implied by the owner as to the condition of the goods, or as to the suitability or fitness of the goods for any purpose.
Upon payment of the damage waiver fee, Citiwest Rentals agrees to waive its rights to claim from the hirer any damage to the equipment, except for the excess listed overleaf, excepting the following cases.
1. misuse or abuse by the hirer.
2. misappropriation or wrongly conversion.
3. Breach of any condition of this agreement.
4. Loss or damage caused by mysterious disappearance of the equipment.
5. Loss or damage caused by the operation of the equipment/vehicle in violation of any statute (Commonwealth or State) or any regulation or by-law thereunder.
6. Loss or damage to tools or accessories including hoses, points, drills, bits, leads and the like.
7. Loss or damage to tyres or tubes.
8. Loss or damage to equipment occurring for any reason whilst located, used, loaded or unloaded, transported on over or adjoining water including without limiting the generality thereof whilst located, used, loaded, unloaded or transported over or on wharves, bridges, barges and vessels of all kinds.
9. Loss of equipment - including theft.
Indemnity: Damage to Property or Person.
The hirer shall be and remain responsible for all and any loss of or damage to property or person caused by the equipment under hire for any reason whatsoever during the period of hire and the hirer shall indemnify the owner and owner's servants and agents in respect of all claims, damages and expenses in relation thereto.
Exclusiion of Liability
The owner shall not be liable to the hirer or the hirer's servants or agents for any damages, suits, actions, claims and demands of any description whatsoever and however arising either directly or indirectly from representations, warranties, terms and conditions express or implied (except insofar as statutory conditions and warranties cannot be excluded under Par V Division 2A of the Trade Practices Act 1974 or relevant State Legislation), use, maintenance, transport, operation of the goods or otherwise and whether resulting the negligence of the owner, its servants or agents or otherwise.
Interpretation
"Period of Hire" - The period of hire shall commence from the commencement date and time as shown overleaf or at the time the equipment is delivered to the hirer whichever is the later and will cease when it is returned to the owner or, if the hirer notifies the owner in writing that the equipment is available for return at a particular place, when it is picked up by the owner from such place provided that the hirer shall cause the equipment to be picked up within five days after such notification is received by the hirer. .
